Terms of Sales

Article 1: object

These conditions of sale aim to define the contractual relationship between Karine Goldberg and the buyer and the conditions applicable to any purchase made through the website www.karinegoldberg.com . The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, which the buyer acknowledges having read prior to his order. 

Karine Goldberg retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of her site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2. Entry into force and Duration

These General Conditions of Sale are applicable to the parties on the date of validation of the order.

These General Conditions of Sale are applicable for the duration necessary for the supply of the products, until the expiry of the guarantees and obligations owed by Karine Goldberg.

Article 3. Products

Karine Goldberg offers for sale the products offered on the “shop” page of the site www.karinegoldberg.com , within the limits of available stocks. Karine Goldberg may at any time modify the list of products offered for sale. The customer is duly informed of this through illustrations, colors and photographs. The descriptive texts made available to the customer on the individual product sheets are only indicative and do not enter into the contractual field. Karine Goldberg cannot be held liable in the event of an error or inaccuracy.

Article 4. Ordering Products

For the purposes of proper execution of the order, and in accordance with article 1316-1 of the civil code, the customer undertakes to provide all the elements of identity authenticity.

All orders placed on the site are intended solely for the personal use of the customer. The latter undertakes not to partially or totally resell the products ordered.

During the realization of the various stages of the order, the customer undertakes to respect the present General Conditions of Sale.

In accordance with Article L. 122-1 of the Consumer Code, Karine Goldberg reserves the right to refuse the order if it appears abnormal (in particular given the quantities ordered), placed in bad faith or for any other reason. inadmissibility, in particular, when there is a dispute with the customer concerning the payment of a previous order.

Article 5. Price of Products and Conditions of Validity

The price of the products sold on the site is indicated respectively by article and by reference, except typographical error. These prices do not include delivery costs which will be invoiced in addition and specified to the customer during the validation of his order.

For any order shipped outside the European Union and/or DOM TOM, the price is calculated excluding tax automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be required in certain cases. These rights and sums are not the responsibility of the seller. They will be the responsibility of the customer and are his responsibility. The seller therefore invites the customer to inquire about these aspects with the corresponding local authorities.

At the time of validation of the order, the price to be paid corresponds to the total amount of the order.

The product offers and their prices are valid as long as they are accessible on the site within the limits of available stocks.

As such, indications on the availability of the products can be provided to the customer at the time of placing the order. Errors or changes may exceptionally exist, especially in the case of simultaneous orders of the same item by several customers. In the event of an unavailability of an article after validation of the order by the customer, Karine Goldberg will inform the customer by e-mail as soon as possible, by proposing either to order a replacement article presented on the site, or to cancel the order. If the customer chooses to cancel the order, the refund will take place no later than 30 days from payment if the customer's bank account has been debited.

Karine Goldberg reserves the right to change at any time and without notice the lists of products and/or the prices offered on the site, it being specified that those in force at the time of the order will be those accepted by the customer by validating the latter.

The validity period of product offers and prices is determined when the site is updated.

 

Section 6.  Payment Terms

Payment is due immediately at the time of the order and by credit card.

The payment of the amount of the order will be made exclusively through the secure payment system STRIPE with the means

following payment methods: VISA or MASTERCARD.

Payments by check and bank transfer are not accepted.

The transaction is debited from the customer's bank card  at the time of dispatch and, after verification of the latter's data, upon receipt of the debit authorization from the company issuing the bank card used by the customer.

Once the payment has been initiated by the customer, the transaction is immediately debited after verification of this information. In accordance with Article L.132-2 of the Monetary and Financial Code, the commitment to pay by card is irrevocable as soon as it is activated.

By communicating the information relating to his bank card, the customer authorizes Karine Goldberg to debit his bank card for the amount corresponding to the total amount of the order.

The customer therefore authorizes his bank in advance to debit his account in view of the records or statements transmitted via the payment module, even in the absence of invoices signed by the hand of the bank card holder.

To this end, the customer confirms that he is the holder of the bank card to be debited and that the name appearing on the card is indeed his. The customer communicates the sixteen digits and the expiry date of his bank card as well as, if necessary, the numbers of the visual cryptogram.

In the event that the debit of the total amount to be paid is impossible, the customer will be invited to start the payment process again. If the impossibility of debiting is confirmed, the online sale will immediately be automatically resolved and the order will be cancelled.

Article 7. Order processing

Orders made on the online store are processed as soon as possible from Monday to Friday. Indeed, no order will be processed during weekends, public holidays and leave periods specified by message.

Article 8. Delivery of the order

The products are delivered to the delivery address which was indicated when ordering. The customer is solely responsible for a lack of delivery due to a lack or error of geographical indication.

The amount of delivery costs depends on the amount and nature of the order. In any case, the amount of these costs is indicated to the customer before the validation of the order.

Subject to availability of the chosen products, the delivery method is specified to the customer throughout the process of validation and payment of the order. The delivery time will depend on the final delivery method.

Delivery times run from the date of confirmation of the order by Karine Goldberg according to the average preparation and delivery times of the order.

Delivery times are given for information only.

In the event of late delivery, the customer has the possibility of terminating the contract according to the methods defined in article L138-2 of the consumer code. The seller then reimburses the product under the conditions of article L138-3 of the consumer code. The seller makes available a point of contact which is indicated in the order confirmation email which makes it possible to ensure its follow-up. The seller reminds that when the customer takes physical possession of his order, the risk of loss or damage to the products is transferred to him. It is therefore up to the customer to notify the carrier of any reservations about the product delivered.

The Customer is required to check the condition of the packaging as well as the items upon delivery.

If the package should be received damaged by the customer, it is up to him to make the reservations and complaints he deems necessary, or even to refuse the package, and this, before it is opened (such as, for example, if you hear a noise breakage inside) . Said reservations and detailed complaints must be indicated to the deliverer and noted in writing on the delivery slip. They must also be sent to the carrier by registered letter with acknowledgment of receipt within three working days, not including public holidays, following the date of delivery of the products. In all cases, it is important to clearly specify the reasons, knowing that a reservation of the type "subject to opening the package" has no value but that a reservation of the type "very damaged package, dog-eared in top left, taped" is an accepted reservation.

The client must also send a copy of this letter to Karine Goldberg. Failure to file a complaint within the aforementioned period extinguishes any action against the carrier in accordance with Article L. 133-3 of the Commercial Code.

If the package is in good condition, but when it is opened, the product is damaged, it is up to the customer to return it to us according to the conditions below for expertise, indicating the reason for the complaint on the return slip.

The customer must ensure that the products delivered to him correspond to the order. In the event of non-compliance of the products in kind or in quality with the specifications mentioned in the packing slip, the customer must return the products, complete and in their original packaging, accompanied by the return form, to the following address:

within seven (7) calendar days following the date of receipt of the order by the customer. It will be up to the customer to provide proof of this return, which assumes that the items must be returned by COLISSIMO, or by any other means giving a certain date, the costs and risks of return remaining the responsibility of the customer.

Article 9. - Right of withdrawal

In accordance with article L.121-20 of the consumer code, "the consumer  has a period of fourteen clear days to exercise its right of withdrawal without having to justify reasons or to pay penalties, with the exception, where applicable, of return costs”. “The period mentioned in the previous paragraph runs from the receipt for the goods or the acceptance of the offer for the provision of services”. The right of withdrawal can be exercised by contacting the seller by email at info@karinegoldberg.fr. In the event of exercise of the right of withdrawal within the aforementioned period, only the price of the product(s) purchased will be subject to the right to reimbursement, the return costs will remain the responsibility of the customer.

Product returns are to be made  in their original condition and complete (packaging, labels, etc.) so that they can be resold as new.

They must be accompanied by a copy of the proof of purchase (proof of payment), and should be sent to:

Article 10. Warranties

In accordance with the law, the seller assumes a guarantee of conformity as well as a guarantee relating to the hidden defects of its products. The seller reimburses the customer for products that are apparently defective or that do not correspond to the order placed. The refund request must be made by email to: info@karinegoldberg.fr and with photos of the defective product when the package is opened, with the date of receipt in support.

Items returned incomplete, damaged, damaged, damaged or soiled by the customer will not be exchangeable.

 

Article 11. Intellectual property rights

Trademarks, domain names, products, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of Karine Goldberg. No assignment of intellectual property rights is made through these GCS. Any total or partial reproduction, modification or use of these goods  for any reason is strictly prohibited.

Article 12. – Protection of personal data

In accordance with the Data Protection Act of January 6, 1978, you have the right to query, access, modify, oppose and withdraw from personal data concerning you.

By adhering to these General Conditions of Sale, you agree that we collect and use this data for the performance of this contract. By entering your email address on our site, you will receive emails containing information and promotional offers concerning products published by the seller. You can unsubscribe at any time. All you have to do is click on the link at the end of our emails or contact us by registered letter with acknowledgment of receipt.

We track traffic to our site, and for this we use tools such as Google Analytics.

Article 13. - Force Majeure

The execution by Karine Goldberg of her obligations under the terms of these General Conditions of Sale will be suspended in the event of the occurrence of a fortuitous event or force majeure which would hinder or delay their execution.

Article 14. - Nullity and modification of the contract

If one of the stipulations of this contract is cancelled, this nullity would not entail the nullity of the other stipulations which will remain in force between the parties. Any contractual modification is valid only after a written and signed agreement of the parties.

Article 15. Limitation of liability

Karine Goldberg cannot be held liable for any damage resulting from the use of the Internet network such as, in particular, loss of data, intrusion, computer viruses, connection break, interruption of the Internet network, or other problems. independent of his will.

Karine Goldberg reserves the right to suspend operation of the Site at any time.

Thus, the customer declares to have read all of these General Conditions of Sale and, where applicable, the Special Conditions of Sale related to a product or service in order to accept them without restriction and without reservation.
